Chong Ke, a lawyer based in Vancouver, Canada, is under investigation for allegedly utilizing an AI chatbot, ChatGPT, to create fabricated legal cases. The controversy arose during a child custody dispute at the British Columbia Supreme Court, where Ke represented a father seeking to take his children overseas amidst a separation dispute with their mother.

Court documents reveal that Ke contacted ChatGPT to source relevant case law examples for her client’s situation. However, the opposing counsel discovered discrepancies and found no trace of the cases referenced by Ke. Subsequently, Ke retracted her submissions, attributing the error to her lack of awareness regarding the accuracy of AI-generated content.

Despite Ke’s apology, the incident prompted concerns about the reliability of AI technology in legal proceedings. While Masuhara recognized Ke’s sincerity and efforts to rectify the mistake, the Law Society of British Columbia investigated her conduct. The society emphasized the importance of maintaining professional standards when leveraging AI in legal practice and underscored the need for diligence and ethical considerations.

The incident underscores broader debates surrounding the integration of AI in the legal profession. It highlights the challenges of ensuring the accuracy and reliability of AI-generated content in legal proceedings.
