Naira Marley and Sam Larry Sue Magistrate and Police, seeking N40 million in Damages

Abdulazeez Fashola, widely known as Naira Marley, and Samson Eletu, also known as Sam Larry, have taken legal action by filing a fundamental rights suit against the Lagos magistrate and the police. This move comes in response to their prolonged detention regarding the death of 27-year-old singer Ilerioluwa Aloba, famously known as Mohbad.

The lawsuit, currently before the Federal High Court in Lagos, lists the police and Chief Magistrate Adeola Olatunbosun as defendants. Naira Marley and Sam Larry are each claiming N20 million in damages.

Their legal representative, Olalekan Ojo (SAN), emphasized in the suit the violation of their rights due to their continued detention at the Homicide Section of the Lagos State Police Command, Panti, Yaba, Lagos State, since October 4, 2023. They are urgently requesting the court to order their immediate release.

The attached affidavits recount that their predicament began on October 3 and 4, 2023, when they were apprehended by the police based on alleged connections to the death of Mohbad. Further details state that on October 4, 2023, the Commissioner of Police sought a 30-day remand order in the Magistrates’ Court in Yaba. Chief Magistrate Adeola Olatunbosun granted the police’s application, allowing for their detention for 21 days.

Lawsuit Details Against Magistrate and Police

Remarkably, the 21-day remand order, granted by Chief Magistrate Olatunbosun, has elapsed on October 26, 2023, and the order has not been renewed. This development has prompted Naira Marley and Sam Larry to pursue legal recourse to ensure their prompt release and seek appropriate damages for their unjust detention.
