In a historic legal triumph, renowned lawyer Dr Monday Onyekachi Ubani (MOU) has secured a groundbreaking victory for car dealers and owners against the Nigerian Customs Service. The victory follows a 2019 incident in which Customs officers invaded and sealed numerous car shops, alleging smuggling or under-assessment during port clearance.

The Registered Trustees of Auto Dealers in Lagos, represented by the esteemed law firm of Dr Monday Onyekachi Ubani, sought legal redress, vehemently condemning the Customs’ raid as a demonstration of gross irresponsibility, impunity, and an abuse of power.

Despite the submission of import and clearing documents, Customs officers persisted in their allegations, initially claiming smuggling and later changing their narrative to false declaration and underpayment.

When warnings and requests were callously ignored, Dr Monday Onyekachi Ubani’s law firm took decisive action by filing a lawsuit against the Nigerian Customs Service Board, the Nigerian Customs Service Board Chairman, and the Comptroller General of Nigerian Customs. The lawsuit aimed to challenge the Customs’ invasion, sealing of business premises, and arbitrary detention of vehicles.

In a recent judgment delivered by the esteemed Justice A. O. Awogboro, the court resolutely declared the invasion and sealing of the car dealers’ business premises as unlawful and arbitrary.

The court issued a compelling order for the immediate unsealing of the premises, granted a perpetual injunction against any future invasions, and directed the Customs to pay a substantial sum of N500 million in damages for the economic losses incurred by the car dealers.
