Court Dismisses Hon Nimi Walson-Jack's Suit Against The Nigerian Bar Association.

The court dismissed the PO because it attempted to examine the substantive issue at an interlocutory stage. The court also held that the justiciability of the action, the status of the claimant, the provision of the NBA constitution, and the internal workings of the NBA, particularly the attendance of the NBA—NEC, cannot be decided without going to the Pleadings, particularly an examination of the facts before the court. As such, the PO is dismissed.

The court held that in a suit seeking declaratory reliefs, the Claimant has to prove their case and can’t rely on the weakness of the defendant’s case. The court noted that the Claimant failed to adduce evidence to show he is a Lawyer called to the Bar; by failing to exhibit his call to bar certificate, the Claimant also could not show that he served as the General Secretary of the NBA. Unfortunately, the court cannot speculate about these facts or take judicial notice of them.

The Claimant’s decision to use an Originating Summons against filing instead of fundamental Human Rights shows that he realized his attendance at the NBA NEC meeting is a privilege, not a right.

The court stated that while no one can be forced to be a member of an association, as soon as one joins, the person is bound by the association’s rules and should be guided by them.
The court noted that the law is that a court will not interfere in the internal affairs of an association except when the association goes against its own constitution.

The court stated that since the defendants conferred the privilege on the claimant, they could strip him of the same privilege. The defendant was not just a lawyer engaged by the Nigerian Lawyers Society (NLS) for incorporation; he is also a member and the Vice President of NLS. He also didn’t deny being a member of the NLS.

The claimant is also not just a member of the NLS but has proved himself worthy to be the VP of NLS. Having committed to a rival association, claimants can no longer attend the NBA NEC, as attendance is a privilege and not a right.

All the questions for determination are resolved in favour of the defendants, and the court dismisses all reliefs sought. A copy of the judgment will be made available as soon as possible.

Court’s Ruling Dismisses Suit Against NBA, Offering Insight into Association Governance and Membership Privileges in Legal Disputes

In FCT/HC/CV/2534/2023, Hon Nimi Walson-Jack sued the Nigerian Bar Association (NBA). The court’s decision, which encompasses both the preliminary objection (PO) and the substantive suit, offers substantial insights into the legal intricacies surrounding membership privileges and the internal affairs of professional associations.

Preliminary Objection (PO):

The court deliberated on the preliminary objection raised by the NBA, the defendants. It observed that the PO sought to address substantive issues prematurely before thoroughly examining the facts in the pleadings.

The court emphasized the necessity of scrutinizing the action’s justiciability, the claimant’s status, provisions of the NBA constitution, and internal NBA workings, particularly attendance at NBA-NEC meetings. Consequently, the PO was dismissed, allowing for a thorough exploration of the case’s merits.

Substantive Suit Analysis:

The court adopted a meticulous approach to ensure justice and fairness in assessing the substantive suit. It reiterated the fundamental principle that in suits seeking declaratory reliefs, the claimant bears the burden of proof and cannot rely on weaknesses in the defendant’s case.

The court noted the claimant’s absence of crucial evidence, such as proof of legal qualification and tenure as NBA General Secretary.

Moreover, the court scrutinized the claimant’s choice to file an Originating Summons rather than a Fundamental Human Rights application. This strategic decision underscored an acknowledgement that attendance at NBA NEC meetings is a privilege contingent upon adherence to association rules.

Membership Privileges and Association Governance:

A vital aspect of the court’s deliberation centred on the nature of membership privileges within professional associations like the NBA. The court affirmed that while association membership is voluntary, individuals are bound by the association’s rules and regulations once they opt-in.

The court underscored the principle that judicial intervention in internal association matters is warranted only in cases of constitutional breaches.

Highlighting the specific circumstances of this case, the court emphasized that the defendants had conferred the privilege of attending NBA NEC meetings upon the claimant. However, the claimant’s association with a rival organization rendered him ineligible for continued attendance. The court’s ruling reaffirmed the defendants’ authority to revoke such privileges in light of conflicting allegiances.

Legal Implications:

In concluding its judgment, the court resolved all questions in favour of the defendants and dismissed all reliefs sought by the claimant. This decision highlights the importance of upholding association rules and the discretion of associations in managing their internal affairs.

This judgment carries significant legal implications, particularly concerning the interpretation of membership privileges within professional associations and the limitations on judicial intervention in association matters. It is a guiding precedent for similar disputes within the legal community and beyond.
