Court of Appeal set to deliver judgment on Governor Adeleke

The Court of Appeal in Abuja will today, by 12 p.m., provide the decision on the appeal filed by Governor Ademola Adeleke of Osun State to challenge the nullification of his election by the state Governorship Election Petition Tribunal.

On March 23, 2023, the appellate court reserved judgment in the appeal after the parties in the matter adopted their written addresses and announced that the date for the decision would be communicated to the parties.
Adeleke and the Peoples Democratic Party, PDP, are praying the appellate court set aside the verdict of the Osun State Governorship Election Petition Tribunal, which sacked him from office.
Justice Tertsea Kume, who led a three-member panel of the Tribunal, had on January 27, in a two-to-one decision, voided the declaration of Adeleke as the winner of the governorship election held on July 16, 2022.
The Tribunal held that Adeleke did not score the majority of lawful votes, adding that the conduct of the election was not substantially compliant with the provisions of the Electoral Act 2022.
According to the Tribunal, the petitioners, Gboyega Oyetola and the All Progressives Congress, successfully established that there was overvoting in 744 polling units in the state.
