Rivers APC Chieftain Acquitted by Court After Two-Year Legal Battle

In a remarkable legal victory, Fubara Ohaka, a prominent member of the All Progressives Congress (APC) and Deputy Chairman of the Youth Movement in Emohua Local Government Area of Rivers State has been acquitted of all charges by a Federal High Court in Port Harcourt following a rigorous two-year trial.

The charges, levied by the Federal Government through the Department of State Services (DSS), encompassed a range of serious allegations, including illegal oil bunkering, terrorism, involvement in illegal refining activities without proper licensing, conspiracy, and other offences.

Presiding over the proceedings, Justice Stephen Dalyop-Pam meticulously examined the evidence presented by the prosecution and found it lacking substantive support for the allegations against Ohaka. Consequently, the judge upheld the no-case submission put forth by Ohaka’s defence counsel, resulting in his discharge and ultimate acquittal.

The trial, which commenced in 2022, reached its conclusion with Justice Dalyop-Pam emphasizing the failure of the Federal Government to establish a compelling case against the APC chieftain. The judge’s ruling underscored the principle of presumption of innocence and the burden of proof resting with the prosecution.

Ohaka, visibly relieved and gratified by the court’s decision, seized the opportunity to address the media outside the courtroom. He vehemently asserted his innocence in his remarks, denying involvement in the alleged illegal activities. Ohaka expressed gratitude to the judiciary for upholding the principles of justice and vindicating him after what he described as a prolonged period of unfounded accusations and legal battles.

Furthermore, Ohaka took the occasion to advocate for thorough and comprehensive investigations by government agencies before initiating legal proceedings, cautioning against the adverse consequences of hasty and unsubstantiated accusations. He highlighted the detrimental impact of his detention during the legal process, emphasizing the need for diligence and adherence to due process in law enforcement efforts.

The acquittal effectively exonerates Ohaka of any wrongdoing associated with the charges against him, marking the culmination of a protracted legal ordeal that has weighed heavily on him and his reputation.

This verdict not only underscores the judiciary’s critical role in upholding justice and protecting the rights of individuals but also serves as a reminder of the importance of adherence to legal principles and standards in the pursuit of justice within society.
