American Bar Association Poised to Oppose Laws Restricting Teaching on Race and Gender

The American Bar Association is set to advocate against laws that ban teaching about race and gender and the prohibition of books covering those topics. In a joint resolution submitted by several ABA entities, they oppose any federal, state, or local laws that restrict the teaching and inclusion of studies on the experiences, roles, and contributions of individuals or groups based on their race, gender identity, sexual orientation, religion, or other identifiers. The resolution also opposes restrictions on books and school resources that address these subjects. The resolution will be voted on during the ABA’s Midyear meeting in Kentucky.

According to a report by the resolution’s sponsors, efforts by lawmakers to curtail teaching about race threaten students’ freedom to learn and receive an inclusive education that equips them with the necessary tools to address societal issues. The report argues that these bans deny students a sense of belonging by excluding their own history from their education. Specific mention was made of Florida’s Stop WOKE Act, which temporarily prohibits discussions on race in classrooms and effectively eliminates any mention of slavery or historical marginalization. Similar bans have been increasing in other states and localities.

Proponents of these laws argue that teaching about racism creates divisions among students and makes them uncomfortable. However, the ABA report contends that these laws eliminate any discussion of race, even on systemic racism, from classrooms. They argue that banning certain subjects in the curriculum threatens children’s right to receive an honest and quality education that enables them to make informed decisions as adult participants in the democratic process.

In addition to advocating against teaching bans, the ABA’s House of Delegates will also consider approving a new law school accreditation rule that requires campuses to adopt free speech policies supporting the expression of ideas.
